By downloading, installing, or using Nuviame ('the App'), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
Nuviame is a personal consideration tracking application for iPhone and iPad (iOS 17.0+). The App allows you to create profiles, record written and voice entries, attach photos, and use AI-powered features to generate summaries. All features are available to all users. Premium subscription removes advertisements.
Nuviame does not require account creation. There is no sign-up, no registration, no email collection. You download the app and use it immediately. We do not store any personal information on our servers.
You must be at least 13 years old (or 16 in the European Union) to use Nuviame. If you are a parent using the App on behalf of a minor, you accept these Terms on their behalf.
You are granted a limited, non-exclusive, non-transferable license to use the App on your personal Apple devices for personal, non-commercial purposes. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works of the App.
All users have access to:
Free users see advertisements. Premium removes ads.
Premium subscription ($4.99/month or $49.99/year) removes advertisements. All other features are identical to the free version. Subscriptions are processed through Apple's App Store. Payment is charged to your Apple ID. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Manage subscriptions in your Apple ID settings. No refunds for unused periods except as required by law.
Free users see advertisements powered by Google AdMob. Ads may be personalized based on your device information and tracking preferences. You can opt out of personalized ads in iOS Settings > Privacy & Security > Tracking. Premium subscribers do not see ads.

By using AI features, you acknowledge that AI-generated content may contain errors and is for reflection purposes only, not professional advice.
You are solely responsible for all content you create in the App and any consequences from your use of the App. You agree to use the App lawfully and not to: violate any laws; harm or harass others; attempt unauthorized access; interfere with App operation; or use the App commercially without permission.
You own all content you create (entries, photos, recordings). Your content is stored locally on your device and automatically synced to your iCloud when signed in. We do not claim ownership of your content. We cannot access your content.
We do not collect personal information. All your data stays on your device. The only external data collection is by Google AdMob for advertising (free users). See our Privacy Policy at nuviame.com/privacy for details.

Nuviame is a personal reflection tool only. The App and all AI-generated content do not provide medical, mental health, legal, financial, or any professional advice. Do not use the App as a substitute for professional consultation. Seek qualified professionals for important decisions.
THE APP IS PROVIDED 'AS IS' WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT DATA WILL BE ACCURATE OR FREE FROM LOSS; OR THAT AI CONTENT WILL BE ACCURATE. YOU ASSUME ALL RISK FROM USE OF THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM, OR $100 USD, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS.
You agree to indemnify and hold harmless Nuviame from any claims, damages, or expenses arising from: your use of the App; your violation of these Terms; your content; or your use of AI features.
We cannot guarantee your data will always be available or free from loss. You are responsible for backing up your data. We recommend enabling iCloud sync and device backups. We are not responsible for data loss from any cause.
We may modify, suspend, or discontinue any aspect of the App at any time. We may release updates. We are not liable for changes to the App.
We may update these Terms. We will update the 'Last updated' date. Continued use after changes constitutes acceptance. If you disagree with changes, stop using the App.
Any disputes shall be resolved through binding individual arbitration rather than in court, except where prohibited by law. You waive participation in class actions. This does not apply to EU users where prohibited by law. Small claims court remains available.
These Terms are governed by applicable laws. For EU users, GDPR and EU consumer protection laws apply. For California users, CCPA applies. Nothing limits your statutory consumer rights.
If any provision is found unenforceable, it shall be limited to the minimum extent necessary, and remaining provisions remain in effect.
